Customs clearance of cars through Diya: what will change?
The Verkhovna Rada of Ukraine has registered a new draft law No. 10380, which promises to introduce electronic customs clearance of cars through the Diya mobile application. This project aims to simplify and speed up the customs clearance process by making it accessible through a smartphone. Let's analyze the key points of this bill and its potential impact on the car market.
The main provisions of the draft law
The draft law provides for the creation of the possibility of electronic declaration of passenger cars using the Unified state web portal of electronic services (Diya portal). This simplification applies to both individuals and legal entities, including car dealers, who will be able to clear cars remotely.
Electronic declaration
The main goal of the draft law is to minimize the human factor and reduce corruption risks. Cars will be priced automatically based on the prices of similar new cars, taking into account wear and tear factors. This will avoid common schemes of undervaluing cars, falsification of sales contracts and other manipulations.
To implement this mechanism, the Cabinet of Ministers should create a Database of the customs value of passenger cars. This base will be managed by the Ministry of Digital Transformation, and the technical administrator will be a state enterprise designated by the Cabinet of Ministers.
Problems and challenges
Despite the obvious advantages, there are some questions regarding the implementation of the new mechanism:
- Sources of data: It is unclear which prices of new cars will be taken as a basis — the customs value when imported into Ukraine, the price including taxes or the sale price from the dealer.
- Country definition: It is not clear which country's price will be used when estimating the value of a new car, especially for models sold in different markets with different prices.
- Availability of models: The question arises, where to get prices for new cars, if the desired model was not imported new by official importers to Ukraine.
- Individual orders: It is difficult to evaluate models that do not have standardized configurations, such as Tesla.
Simplification of the procedure
For customs clearance of a car through Diya, you will only need to provide a registration document and a sales contract or invoice. No other documents will be required. The customs clearance process will take no more than one hour from the moment of submission of all necessary documents at the checkpoint.
Peculiarities of customs clearance
The new draft law provides that a certificate of conformity is not required for customs clearance, which will allow the import of any passenger car, including a retro one, that does not meet eco-standards. However, it will be possible to obtain license plates and use such a car only after obtaining a certificate of conformity.
Impact on the market
Experts of the Auto Market Research Institute believe that the new mechanism will significantly simplify the import of passenger cars, in particular for citizens, and will reduce the bureaucratic burden on legal entity importers. Transferring a significant number of stages of customs clearance to electronic form will reduce corruption risks and speed up the customs clearance process.
Prospects and chances of success
The project concerns only passenger cars, no simplified options for customs clearance are offered for other types of vehicles. The implementation of such a mechanism will require significant preparatory work, including the creation of a database, relevant sections on the Diya portal, and electronic communications between departments. This can take about a year or more.
Given the support from the country's key political leaders, the chances of the bill's adoption are quite high. The draft law has the potential to change the rules of the game on the Ukrainian car market, making the customs clearance process more transparent and convenient for all participants.
